Welcome to MyNextRoom. These Terms of Use ("Terms") govern your access to and use of the MyNextRoom mobile application and website (together, the "Platform"). By creating an account or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use MyNextRoom.

1. What MyNextRoom Is (and Is Not)

MyNextRoom is an information platform that allows users to browse, post, and communicate about room listings in Ireland. Our goal is to make it easier for students and young professionals to find accommodation.

Specifically, MyNextRoom does not:

• Act as an estate agent, broker, or intermediary in any property transaction
• Guarantee the accuracy, legality, or quality of any listing posted by users
• Participate in, facilitate, or oversee any rental agreement, lease, or financial transaction between users
• Provide legal, financial, or property advice of any kind
• Inspect, approve, or certify any property listed on the Platform

All listings on MyNextRoom are created and managed entirely by individual users. We simply provide the technology for users to find and contact each other.

2. Limitation of Liability

Because MyNextRoom is only a platform connecting users, we are not a party to any agreement you enter into with another user. This includes, but is not limited to, lease agreements, rental contracts, deposit arrangements, or any verbal or written promises made between users.

MyNextRoom is not liable for:

• Financial loss. Any money lost through transactions, deposits, advance payments, or fees exchanged between users
• Scams or fraud. Any deceptive, misleading, or fraudulent conduct by another user on the Platform
• Property damage. Any damage to property, belongings, or premises arising from a rental arrangement
• Disputes between users. Any disagreement, conflict, or legal dispute that arises between a tenant and a room provider
• Listing accuracy. Any false, outdated, or misleading information contained in a listing, including rent amounts, availability, photos, or property descriptions
• Personal safety. Any harm, injury, or unsafe conditions encountered at a property or during a meeting with another user

To the maximum extent permitted by Irish law, MyNextRoom, its operator, employees, and affiliates shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Platform.

3. Your Responsibility: Do Your Own Checks

MyNextRoom does not verify or confirm:

• The legal identity or real name of any user
• The criminal background or history of any user
• Whether a user actually owns or has the legal right to rent out a property
• Whether a property exists, is habitable, or matches its listing description
• The financial reliability or trustworthiness of any user

What we strongly recommend

Before entering any arrangement with another user, you should:

1. Visit the property in person before paying any money or signing any agreement
2. Verify the landlord's identity by asking for proof of ownership or their Residential Tenancies Board (RTB) registration
3. Never transfer large sums of money to someone you have not met in person and whose identity you have not confirmed
4. Get everything in writing. Ensure any rental agreement is documented and that both parties have a signed copy
5. Know your rights. Familiarise yourself with Irish tenancy law and the RTB at www.rtb.ie

Any financial transaction, deposit payment, or rental agreement you enter into with another user is solely between you and that user. MyNextRoom bears no responsibility for the outcome of such arrangements.

4. Acceptable Use Policy

By using MyNextRoom, you agree to use the Platform lawfully and respectfully. You must not:

Prohibited content

• Post fake, fraudulent, or misleading listings
• Use photos, descriptions, or prices that do not accurately represent the property
• Post listings for properties you do not own or have no legal right to rent
• Post duplicate or spam listings

Prohibited behaviour

• Harass, threaten, intimidate, or abuse other users through messages or any other means
• Discriminate against other users based on race, gender, religion, nationality, sexual orientation, disability, or any other protected characteristic under Irish law
• Use the Platform for any illegal activity, including but not limited to fraud, money laundering, or tax evasion
• Attempt to collect personal information from other users for purposes unrelated to accommodation
• Impersonate another person or create a false identity
• Interfere with, disrupt, or attempt to gain unauthorised access to the Platform or its systems

5. User Accounts

When you create an account on MyNextRoom, you agree to:

• Provide accurate and truthful information
• Keep your login credentials secure and not share them with others
• Be responsible for all activity that occurs under your account
• Notify us immediately if you believe your account has been compromised

You must be at least 18 years old to create an account and use MyNextRoom.

6. Account Suspension and Termination

We reserve the right to suspend or permanently terminate any user account, at our sole discretion, without prior notice, if we reasonably believe that:

• The user has posted fraudulent or misleading listings
• The user is engaging in scam activity or attempting to defraud other users
• The user is harassing, threatening, or abusing other users
• The user is violating any provision of these Terms
• The user is using the Platform for any illegal purpose
• Continued use of the account poses a risk to other users or to the Platform

If your account is terminated, you will lose access to all data, listings, messages, and content associated with your account. We are not obligated to provide prior warning, justification, or an appeals process, though we will endeavour to act fairly.

7. Intellectual Property

The MyNextRoom name, logo, design, and all original content created by us (excluding user-generated content) are the intellectual property of MyNextRoom and its operator. You may not copy, reproduce, distribute, or create derivative works from our Platform without our written permission.

By posting a listing or content on MyNextRoom, you grant us a non-exclusive, royalty-free licence to display that content on the Platform for the purpose of providing the service. You retain ownership of your content and can remove it at any time by deleting the listing or your account.

8. Third-Party Links and Services

MyNextRoom may contain links to third-party websites or services (for example, map providers or external property listings). We do not control, endorse, or take responsibility for the content, privacy practices, or availability of these external sites. Accessing them is at your own risk.

9. Disclaimer of Warranties

MyNextRoom is provided on an "as is" and "as available" basis. While we work hard to keep the Platform running smoothly, we do not guarantee that:

• The Platform will be available at all times without interruption
• The Platform will be free of errors, bugs, or security vulnerabilities
• Any information on the Platform (including listings) is accurate, complete, or current
• The Platform will meet your specific requirements or expectations

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify and hold harmless MyNextRoom, its operator (Janmesh Joshi), and any associated parties from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any law or the rights of any third party
• Any content you post on the Platform
• Any dispute between you and another user

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Ireland. Any dispute arising from or relating to these Terms or your use of MyNextRoom shall be subject to the exclusive jurisdiction of the courts of Ireland.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

12. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through the app or by email. Your continued use of MyNextRoom after changes are posted constitutes your acceptance of the updated Terms. The "Last Updated" date at the top of this page will always reflect the most recent version.
